Was in Plymouth 1 643, moved to Eastham. Married Lydia Doane, son of John Doane. Ch: Dorcas-2/14/1652; Margare t - 3/9/1651. Representative 1649. In later years moved to Barnstable, then promoted the sett lement of Dartmouth where he moved before 1670. (Source: Savage. See also Hodge, p. 59) . The following copied from DeForest, "Moore and Allied Families", pp 300-306: Samuel Hicks came on the Anne (to Plymouth Colony) with his mother in 1623 and is first m entioned in that year when his father received four lots in the right of his wife and childre n. In 1627 when the cattle were divided, Samuel next appears with his family. A record from the Plymouth Chuch records is curious because apparently there was no othe r Samuel Hicks to whom it could refer. It is possible that this Samuel Hicks did become a Qua ker as the record alleges, since his wife Lydia was fined in 1660 for attending a Quaker meet ing. This record of the Plymouth Church, made in 1637, reads:"Not very longe after this one S amuell hickes a member of the Church began to be vnsetled about seuerall of the ordinances o f Jesus Christ; and qvestioned seuerall of them about baptising of Infants singing of Psalm s and seuerall other prticulars; which occationed the Calling of the Church together .... hau eing lately Receiued a Paper from out brother Samuell hickes Contianing severall qveryes to t he Number of 14 in which he Reqvireth a prticulare text of Scripture by vs to be produced fo r our practice.... this poor vnsettled man fell yett further and further, and att last becam e a qvaker; and about the Indian warr time hee died." The date of Samuel Hicks' death is no t known. It is possible that he died about the time of King Philip's War, yet the identificat ion is doubtful. On Jan 7, 1638/9, Samuel Hicks brought before the General Court an argument he had had wi th Josias Winslow. Samuel had cut some wood on land granted to Josias, and the latter had tak en it away from him. In the hearing the "wood was prooed to be reseued for fire wood for th e towne, by auncient order & excepted also in the graunt of the said lands, The Court ordere d the said plaintiff to haue the said wood as pply belonging to him, and the deffent to pay t he charges of the Court." Evidently possessed of some means, Samuel, on Feb 11, 1639/40 bought a house and 12 acres , 7 acres of meadow, and three cows from his father for L120, and on Jan 4, 1641/2, he undert ook to pay one-sixteenth of the estimated cost of L200 of building "a Bark of 40 or 50 Tunn" . The town granted him 5 acres of meadow on Nov 2, 1640, and on Mar 1 1641/2 he was made free man. He first served as a juror in 1642, and was repeatedly called on as a juror in later yea rs. As early as 1642, he may have been considering a removal from the town, because in that y ear the town gave him 4 acres of upland on the condition that he remained there. In 1643 he w as taxed half a peck of "The Corne levyed for the Cow Keeps psent use". He was a resident o f Plymouth in August 1643, when he was on a list of those men between the ages of 16 to 60 wh o were able to bear arms. On Sept 11, 1645, Samuel Hicks married Lydia Doane at Plymouth. This is the last record o f him in the town at this time, and he apparently soon removed to Nauset or Eastham, as it i s now called, also in Plymouth Colony. There he was Constable on June 2, 1646. A more importa nt office was soon entrusted to him when he represented the town at the General Court of th e Colony on June 7 , 1648. On June 8, 1649, he was mentioned among those who had "serued at t his Court and the Aiornments thereof." He apparently soon returned to the town of Plymouth, and was certainly there by Feb 1651/ 2 when his daughter Dorcas was born there. He was quite active in real estate transactions, b oth in buying and selling, and served many times on the Grand Inquest. In March 1651, Samuel , (lot 9) and his mother "Mistris Margarett hickes" (also lot 9) appeared in a list of "The N ames of those that have Interest and proprieties in the Townes land at Punckateesett over aga inst Road Iland." He was probably the man meant by the record of August 2, 1659, of the General Court, whe n a "paire of wheeles" had been attached by mistake by the Marshal at Sandwich, but "the Cour t haueing receiued certaine information that the said wheeles did belong to Samuel Hickes, an d were really his before they were attached, haue relinquished them, and haue ordered the sai d Samuel Hickes to require them and improue them as his owne." Samuel's brother Ephraim had died at Plymouth on December 12, 1649 and administration ha d been granted to his mother, Mrs. Margaret Hickes, on Mar 6 , 1648/50, and the Court ordere d that she should have the estate and on Mar 11 she gave bond as administrator. However, Ephr aim had attempted to make a will, and apparently by virtue of this will, Samuel claimed the e state. On Mar 1, 1650/51, Samuel Hicks, "being possessed of the whole estate of my Brother Ep hraim hickes Deceased" made an agreement with his mother whereby he should pay to ""my aged a nd much honored mother' L15 in wheat and rye at L5 a year, and agreed not to "trouble or moll est my aged mother .... about the estate above mentioned." On Dec 3, 1660, the Plymouth Colon y Court ordered that because Ephraim Hickes had died a violent death on Dec 12, 1649, and wa s not in a condition to make a legal will, his nuncupative will was invalid. The Court at tha t time "orderd that the said estate should baee improued for the comforst and support of Mist ris Margarett Hickes, the mother of the said Ephriam Hickes, in her age and widowhood." The o rder had not been recorded at the time, but upon a complaint from Margaret Hicks it was renew ed in 1660. Meantime the rest of the family was taking action against Samuel. Robert Hicks had bee n 1 of the 34 original owners of a tract of land at Acougheusse, later Dartmouth, in Plymout h Colony, but by some mistake Samuel's name was entered instead, and other heirs of Robert pe titioned the Court on May 1, 1660 to rectify the mistake. On Mar 5 1660/1, The Court ordere d "the said Mararett Hickes shall chose one man, and Samuell Hickes another man, to arbetrat e the case beween then." On June 7, 1661, it was decided by agreement that the difficulties b etween Margaret and Samuel about the will of Robert and about the goods of Ephraim should b e settled thus: Samuel was to pay his mother L10, 1/2 by Dec 1st and 1/2 in Oct 1662, "the wi nescott bedsted and the table in the hall to remaine to the house as ti now stands' and Samue ll Hickes doth promise, that incase hee doth remoue from Plymouth , that hee will not put an y into the house that shalbee injuriouse and offenciue to his mother; neither will he molst o r trouble any by reason of any psent etate his mother is now possessed of, the house remainin g to him att his (Ephraim's) decease." Even slower in settlement were Samuel's differences about his father's property, for on O ct 3, 1662, "a tender was made vnto Samuell Hickes by the Court to come to an equall deuisio n with others enterested in the lands of Mr Robert Hickes arr Acushena, Coaksett, and place s adjacent; and the said Samuell Hickes hath refused the same." The Court therefore undertoo k to make the division. It is difficult to think of such a combative person as a Quaker, yet if it is really th e same man, he is so described in the early church records of Plymouth, and on Oct 2, 1660 hi s wife Lydia Hicks of Plymouth was fined for attending Quakers' meetings. Curiously enough, S amuel himself was serving as a juror at tie session of the Court. Possibly because fo the quarrel over his father's and brother's land, or perhaps for som e other reason, Samuel Hicks left Plymouth and removed to Barnstable, Plymouth Colony, wher e he was admitted as an inhabitant on Oct 3, 1662. How long he stayed here is not known, bu t by 1666, he had again removed, and settled at Dartmouth (Achushena). Here on July 5, 1666 , "Att this Court, a certaine Indian named Daniell, allies Tumpasscom, was presented before t he Court , and examined concerning his strikeing of Samuell Hickes, of Acushena soe as said S amuel Hickes languisheth and is in danger of death; hee, the said Indian, confesseth that he e strucke or punched the said Hickes with an axe, but saith that the said Hickes first struck e him; the said Indian was returned to prison, there to remaine in close durance vntill the l ast Tuesday in Oct 1666." On October 31,1666, he had recovered, but to recompense him becaus e he had been "much hindered in his time and occations", the Indian was ordered to pay Hick s L4, 4s, for loss of time, and also 4s to John Haward for coming to Plymouth with him by ord er of the Constable. Again Hicks had been involved in a violent episode for a Quaker. On April 2, 1667, Sergeant James Shaw was chosen to exercise the inhabitants of Dartmout h in arms, and to advise with 3 others, including Samuel Hicks, "in case of any danger presen ting for the best defense of the place in such respect". On June 5, 1667, Samuel Hicks wa s a Selectman of Dartmouth, and on the same date he was appointed a Receiver of Excise at Dar tmouth. He was among the freemen of Dartmouth on May 29, 1670, an on June 7, 1670 was again S electman there. Samuel Hicks owned property at Dartmouth on Oct 27, 1685 and on Mar 2, 1685/6. When the a dministrator gave bond for the administration of the estate of George Watson of Plymouth (hi s brother-in-law) on Mar 14, 1688, Samuel was a witness. These entries may refer to either th is Samuel or his son Samuel. If the earlier record really refers to this man as dying about t he time of King Philip's War, these later records are of course about his son. It is known from Margaret Hicks will that Samuel Hicks had 7 children in 1666. The birt h of only 2, Dorcas and Margaret, are recorded. However no other Hicks are known to have bee n at Plymouth and Dartmouth so early, and it seems certain that Sarah was the daughter of Sam uel. An intensive search has been made in the original records of the present Plymouth and Br istol Counties in Mass, without the expected evidence being found on this point. Samuel & Lydia (Doane) Hicks had the following children: 1. Unknown 2. Unknown 3. Unknown 4. Samuel, who was born in 1651 5. Dorcas, who was born Feb 14. 165/52 at Plymouth 6. Sarah 7. Margaret, who was born Mar 9, 1654/55 at Plymouth. Her grandfather Doane left her a be quest in 1678. . That concludes the work of DeForest in 1938. Hodge writing in 1976 gives the list of chil dren as given in this file - adding Thomas (of Dartmouth & Portsmouth, RI), Robert, and proba bly John and Joseph. (Joseph had 9 children born at Dartmouth and listed there in the town re cords.) Robert mentions a deceased brother John in his will of 1707. Further information on s ome of these is found in Austin, "Genealogical Dictionary of RI". This, if correct, gives a t otal of 8 children, 1 of whom must have been born after the 1666 date of Margaret Hickes will , since there are records for all 8 after that date. Other lists include a Joanna Hicks, wh o was married at Eastham on Mar 22. 1693/4 to Robert Young. (Eastham VR) . Comments by Mary Hix Brown in a Westport, MA Bicentenial Interview (http://www.leesmarket .com/History/bicentennial_interviews/Mary_Hix_Brown. htm) ----Robert Hix had a son, Samuel, who first went to Easton where he married a Doan. The R everend Doan is buried down at Easton. Then he went to Nauset near the Nauset Light, where on e was fined for attending Quaker Meetings and then Dartmouth was opened up for settlement an d they came to it. They purchased Dartmouth from the Indians about 1640. You see Dartmouth wa s incorporated in 1664, so he came to what is now East Fairhaven and settled on what is now S haw's Cove at Mattapoisett Neck. He had a farm there on the brook. There they had trouble wit h the Indians because the Pilgrims herded these Indians into various reservations. They had o ne at Freetown and one at Mattapoisett Neck. Most of this was worthless land and Samuel Hick s happened to have the only water supply available, and he had arguments with the Indians bec ause they had the only good fishing hole.
